Intent of Proposed Revision to the
Administrative Code Part 2830
The
proposed revisions to the Administrative Code Part 2830 are not substantial
and do not remove the LPNs ability to assume the "charge nurse"
role. The
LPNs scope of practice has not changed. The purpose of the revision is to
clarify the role of the LPN as it pertains to assessment
to describe what they actually do.
The function of the LPN related to
assessments remains the task of observation, recording, and reporting to the
appropriate person the signs and symptoms indicative of change in the
patient’s condition and/or responses to nursing interventions.
Rule 2.5 has not changed, "LPNs may assume "charge
nurse" responsibilities:

In nursing
situations where rapid change is not anticipated and supervision is
provided by a RN who is physically on the premises where the patient is
having nursing care provided.

In
long-term units if RN supervision is available at all times for
consultation."
The revised
language in Rule 2.6 does not prevent the LPN from assuming "charge nurse"
responsibilites.
In addition, the Rule 2.6 does not
prevent compliance with the minimum standards set forth by the
Mississippi State Department of Health. RN supervision is still required, that component has not changed
and does not interfere with existing and/or proposed board rules. In
actuality, the LPN role is dependent and they function in a role subject to
the supervision requirements outlined in 30 Miss. Admin. Code Pt. 2830, R.
2.1 "The LPN gives nursing care under the direction of the RN, licensed
physician, advanced practice registered nurse or licensed dentist which does
not require the specialized skill, judgment and knowledge required of a RN."
The proposed rules do not change the scope of
practice of the LPN. There are no drastic changes that would effect current
operations and compliance with minimum standards.

The LPN renewal
period was from October 1, 2011 to December 31, 2011.
If you did not renew during the renewal period you must apply for
reinstatement (late renewal). The fee is $150.00 from January 1st to 31st;
$250.00 from February 1st to June 30th.
If you were
selected for an audit for LPN expanded role you should submit your evidence (ONLY
UPON REQUEST) as soon as possible. If your evidence of completion was not
submitted by December 29, 2011, your expanded role certification will be interrupted. As a
reminder, performing an expanded role without certification is grounds for
disciplinary action.

Proposed Changes in Administrative
Code
November 18, 2011
The Board of Nursing is
proposing amendments to the Mississippi Administrative Code, Title
30: Professions and Occupations, Part 2830, Chapter 1: Functions of the
Registered Nurse, and Chapter 2: Functions of the Licensed Practical Nurse.
These proposed revisions have been filed with the Office of Secretary of
State.
An open hearing will
be held at 11:00 a.m. on Friday, December 9, 2011, at the Board of Nursing,
1080 River Oaks Drive, Suite A100, Flowood, Mississippi, to afford the
public an opportunity to express their views. The board is also seeking
written comments that may be submitted to the Board of Nursing by Wednesday,
December 7, 2011. Comments may be emailed to
nherrin@msbn.state.ms.us
or submitted in writing to 1080 River Oaks Drive, Suite A100, Flowood, MS
39232-9779. After a review of public and written comments, the board will
consider adoption of the proposed regulations during their business meeting
on December 9, 2011, following the public hearing. The proposed amendments

Licensed Practical (LPN) License Renewal
LPN RENEWAL
All LPN
licenses and expanded role certifications expire on December 31, 2011. LPNs
with expanded role certification can renew online without having to complete a
separate hardcopy recertification application. Please DO NOT
send evidence of contact hour completion to the board office for expanded
role certification unless requested by the board through audit.
The LPN renewal
period is from October 1, 2011 to December 31, 2011.
If a license is renewed after December 29, 2011, the online licensure
verification system may not reflect the current status of the license until
January 4, 2012, due to the New Year's holiday. With this is mind, renew
your license as soon as possible within the renewal period to avoid last

Administrative Code (Formerly Rules and
Regulations).
Beginning August 12, 2011, the Mississippi Board of Nursing’s Rules and
Regulations will be referred to as the board’s administrative code.
To
comply with the Mississippi Administrative Procedures Law, Miss. Code
Annotated, 25-43-1.101 et seq., Miss. Code of 1972, the Board of Nursing
submitted a compilation of rules and regulations in an organizational
structure set forth by the Office of Secretary of State. The basic
organization of the board’s rules and regulations was reformatted under a
designated numbering system that changed chapters and sections to parts,
chapters, and rules. Content was not altered; however, the name has
changed from rules and regulations to administrative code. An example of
the changes is “Chapter III, Practice of Nursing” in the rules and
regulations will now be “Part 2830, Practice of Nursing” in the
administrative code. Previously, the board’s rules and regulations’ citation
was written as “Rules and Regulations, Chapter II, Section 1.8.” The
administrative code citation format will now be: “Miss. Admin. Code, Pt.
2810 R. 1.8.”

Certified Clinical Hemodialysis Technician
Certification
Certified Clinical Hemodialysis Technicians (CCHT) certifications issued by
the Mississippi Board of Nursing expired on July 31, 2011. The renewal
period was
from May 1, 2011 to July 31, 2011. To maintain the privilege to practice as
a CCHT you must have a current national certification and apply for
reinstatement with the Mississippi Board of Nursing. A reinstatement
application can be acessed under the Applications section. If you do not
reinstate
your Board certification, it will not be current.
Practicing without a current Board certification is a violation of the
Mississippi Nursing Practice Law.

Reminders for APRNs
1. The
controlled substance privilege is now being granted to those who apply
for Schedules II-V only. If you have only had 4 & 5 in the past when
you renewed Jan 1, 2011 you were now granted II-V. You must notify the
DEA of this change!
2. New
APRN's who wish to apply for controlled substance privilege MUST HAVE
COMPLETED their 720 hours first. Then you may apply and please note
that you are no longer required to take the 10 credit additional
course. HOWEVER, if you graduated prior to 1993 you will still be
required to take this course as controlled substances were not part of
the curriculums at that point. If you graduated from a school outside
of MS and it is a state where the controlled substance privilege is
not permitted you may also be required to take this additional course so
please contact the BON prior to your application.
3. Please
watch your emails as soon you will be asked to send a copy of your most
current certification and DEA certificates so that we can keep track
with the currency of both. When you recieve this email please send it
promptly.

Board Adopts Revised
Rules and Regulations for APRNs
Effective Date June
10, 2011
On April 8, 2011,
revisions to Chapter IV, Sections Section 2. 2.1 c (4), 2. 2.1 e (1) and 2.
2.3 c (2) of the Mississippi Board of Nursing Rules and
Regulations were adopted by the board and will become effective June 10,
2011. The revised language follows:
Mississippi Board of
Nursing Rules and Regulations Chapter IV, Section 2. 2.1 c (4)
Documentation of
current national certification as an APRN in a designated area of practice
by a national certification organization recognized by the board. In the
case of a lapse in certification, the APRN
must stop practicing immediately until such time as certification is
renewed.
Mississippi Board of
Nursing Rules and Regulations Chapter IV, Section 2. 2.1 e (1)
Relationship with
collaborating physician/dentist.
The APRN
shall notify the board immediately regarding changes in the
collaborative/consultative relationship with a licensed physician or
dentist. In the event the collaborative physician is unable to continue
his/her role as collaborative physician, the APRN may be allowed to continue
to practice for a 90-day grace period while the APRN attempts to secure a
primary collaborative physician. The Mississippi State Board of Medical
Licensure or its designee will serve as the APRN’s
collaborative physician with the agreement of the Mississippi Board of
Nursing. The Mississippi State Board of Medical Licensure and the
Mississippi Board of Nursing will assist the APRN in his/her attempt to
secure a collaborative physician. If a collaborative physician has not been
secured at the end of the 90-day grace period, an additional 90-day
extension may be granted by mutual agreement of the executive committee of
the Mississippi Board of Nursing and the executive committee of the
Mississippi State Board of Medical Licensure. During this additional 90-day
extension, the above described collaborative agreement will continue.
Mississippi
Board of Nursing Rules and Regulations Chapter IV, Section 2. 2.3 c (2)
APRNs practicing in
other specialty areas must practice according to a board‑approved protocol
which has been mutually agreed upon by the APRN and a Mississippi licensed
physician whose practice or prescriptive authority is not limited as a
result of voluntary surrender or legal/regulatory order.

The Board of Nursing has completed a review of the Mississippi Rules and
Regulations and revisions are now being proposed throughout all chapters to
accommodate innovations in technology, advances in health care and changes
in the Nursing Practice Law. An intent to adopt proposed revisions
throughout Chapters I -VIII has been filed with the Office of Secretary of
State in accordance with the Administrative Procedures Act.
An open hearing will be held at 11:00 a.m. on Friday, December 3, 2010, at
the Board of Nursing, 1080 River Oaks Drive, Suite A100, in Flowood. The
purpose of this hearing will be to afford the public an opportunity to
express their views on these proposed revisions. The board is also seeking

LICENSE WALLET CARDS WILL NO LONGER BE ISSUED
Starting September 2010, license wallet cards will no longer be distributed.
The traditional license wallet card will no longer be produced for nursing
licenses. The paperless licensure decreases the potential for fraud.
You or your employer may check the status of your license by using our
online licensure verification system as the primary source free of charge. Please review

Additions to
Nursing Practice Law: Criminal Background Checks
Additions to the Mississippi
Nursing Practice Law became effective on July 1, 2010. Through additions
to Miss. Code Ann.
Sections 73-15-17, 73-15-19 and 73-15-21, the Board of Nursing now has the
legal authority to conduct criminal background checks and fingerprinting for
RN and LPN graduates, nurses endorsing into Mississippi and nurses
requesting reinstatement of lapsed licensure. The specific additions are

NCLEX Quick Results Now Available For
Mississippi
NCLEX quick results are now available for Mississippi NCLEX examination
candidates. The results are unofficial and are not synonymous with
licensure. Candidates will need official licensure and notification from the
Board before being allowed to practice as a licensed nurse. Allow at least 7
to 10 business days to receive official licensure and notification from the

LPN Licenses Expired December 31, 2009
The LPN licensed renewal period was from October 1, 2009 through December
31, 2009.
LPNs that did not renew your license by December 31, 2009, will have to
apply for licensure reinstatement. You may apply for reinstatement using the
online licensure renewal or submitting a completed hard copy application to
the board office. An additional fee will be incurred for licensure
